Filing

The filing step of a patent application is the official submission of the patent documentation to a patent office, marking the start of the patenting process. Here’s an overview of the key elements involved:

Prepare the Application:

the invention, claims that define the scope of protection, any necessary drawings, and an
abstract summarizing the invention.

application may be filed with national offices (e.g., USPTO in the U.S., EPO in Europe) or
through international systems (e.g., WIPO’s Patent Cooperation Treaty – PCT).

File Electronically or by Paper:

Most patent offices encourage electronic filing to simplify the
process and reduce costs, although paper filing is still an option in many jurisdictions.

Pay the Necessary Fees:

Filing fees are required, and they vary depending on the jurisdiction,
type of patent (provisional or non-provisional), and other factors like the size of the entity
filing (small business, individual inventor, etc.).

Obtain Filing Date:

The patent office will assign a filing date once all the required documents
are submitted. This date is crucial as it establishes the priority of your patent rights.

Receive a Filing Receipt:

After successful submission, the patent office provides a filing
receipt or acknowledgment with an application number. This is important for tracking the
application throughout the examination process.

Publication (for Non-Provisional Applications):

Typically, 18 months after the filing date, the
application will be published by the patent office, making the details publicly available unless
requested otherwise.

At this stage, the application enters the examination phase, where the patent office will review its novelty, usefulness, and non-obviousness before deciding whether to grant the patent.
